1. About Memorabilia.auction
Memorabilia.auction is operated by Auksjonarius AS, registration no. 837 090 342 (Norway). The platform serves as a digital marketplace and auction platform for the purchase and sale of memorabilia and collectibles between sellers and buyers.
Memorabilia.auction facilitates contact and agreement between seller and buyer, and supports the execution of payment via third-party solutions as described in Section 5. Memorabilia.auction is not a party to the purchase agreement between buyer and seller.
2. Registration and User Account
To participate in auctions as a buyer or seller, you must register with your full name, email address, phone number, and address. You must be at least 18 years old to register an account and participate in auctions on Memorabilia.auction.
Only one person may use a registered account. The user is solely responsible for all activity associated with the account and must keep login credentials secure.
By registering, you confirm, through active checkbox consent, that you have read, understood, and agree to these terms.
3. Roles and Responsibilities
3.1 Seller's Responsibility
- The seller is the legal party to the sale and is responsible for providing accurate and complete information about the item, including condition, any defects, and provenance.
- The seller is solely responsible for the authenticity, condition, ownership rights, and legality of selling the item, including that the sale does not infringe any third-party intellectual property rights.
- The seller warrants that they have the right to sell the item and that the information provided is accurate to the best of their knowledge.
3.2 Buyer's Responsibility
- The buyer is solely responsible for assessing the item and the information provided before placing a bid.
- Bids are binding, and the buyer is responsible for familiarizing themselves with the auction rules in Section 4 before placing a bid.
3.3 Memorabilia.auction's Responsibility
- Memorabilia.auction facilitates the auction platform and the technical execution of payment as described in Section 5, but is not a party to the purchase agreement between buyer and seller.
- Memorabilia.auction has no responsibility for the authenticity or condition of the item, or for whether the seller or buyer fulfils their obligations under the agreement, except as required by mandatory law.
- Memorabilia.auction disclaims liability for indirect losses arising from defects or deficiencies in items, to the extent permitted under applicable law.
- Disputes between buyer and seller are handled directly between the parties. Memorabilia.auction has no obligation to mediate, investigate, or resolve such disputes, but may, at its own discretion, assist by forwarding contact information.
4. Auction Rules
- Bids are binding. When the bidding deadline expires, the highest bid wins.
- There is no right of withdrawal on items purchased at auction, to the extent the auction qualifies for the relevant statutory exemption for public auctions under applicable consumer protection law, including that the consumer has a genuine opportunity to be present at the auction.
- Seller and buyer undertake to complete the transaction in accordance with applicable law and these terms.
- Auctions are extended for a short period in the event of bids placed close to the deadline.
- Buyers should review the item's description, images, and any seller history before placing a bid. Memorabilia.auction recommends contacting the seller with questions in case of uncertainty before bidding.
5. Payment and Settlement
- Payment occurs directly between buyer and seller. Memorabilia.auction does not receive payment on behalf of the parties beyond the platform's own fee, see Section 6.
- Buyer and seller must independently agree on payment, delivery, and any applicable VAT between themselves.
- Memorabilia.auction uses Stripe and Stripe Connect as its primary payment partner.
- All buyers and sellers must register a valid payment card to participate in auctions or place bids. Card information is stored securely with Stripe and not with Memorabilia.auction.
- Upon sale, the buyer is automatically charged the purchase amount through Stripe if the seller has chosen to use Stripe.
- Payment from buyer to seller is made directly via Stripe Connect if the seller has activated this option. Memorabilia.auction never transfers funds on behalf of the parties beyond its own fee.
- Memorabilia.auction automatically deducts the platform's buyer and seller fees directly via Stripe.
- Sellers who do not wish to use Stripe may offer alternative payment methods outside the platform, such as PayPal, Vipps, bank transfer, or another chosen solution. Settlement and responsibility for payment are then handled directly between buyer and seller, and Memorabilia.auction has no visibility into or responsibility for such transactions.
- Memorabilia.auction is not responsible for the execution, delay, or default of transactions between the parties, regardless of the payment method chosen.
6. Fees and Costs
- Memorabilia.auction charges a 5% transaction fee to both buyer and seller upon completed sale via Stripe.
- No fees apply for creating an auction listing or for unsold items.
- The fee rate may be changed with prior notice, see Section 13.
7. User-Uploaded Content
- The seller is responsible for ensuring that images, descriptions, and other content uploaded do not infringe third-party copyright or other rights.
- By uploading content, the user grants Memorabilia.auction a non-exclusive right to display and use the content in connection with the operation and marketing of the platform.
- Memorabilia.auction may remove content that clearly infringes third-party rights or violates these terms.
8. Privacy and GDPR
Memorabilia.auction processes personal data in accordance with applicable data protection law and the EU General Data Protection Regulation (GDPR).
8.1 What Information Is Collected?
- Name, address, email, phone number
- Bid history, invoice overview, and payment status
- Items marked as favorites
- Registered payment card (stored only with Stripe)
- Any payment method preferences (Stripe, PayPal, Vipps, or other)
8.2 What Is the Information Used For?
- Transactional communication related to bids, winning notifications, and auction follow-up.
- Automatic charging of fees to Memorabilia.auction upon sale.
- Transfer of the purchase amount to the seller via Stripe Connect, if selected.
- Sending newsletters (you may unsubscribe at any time).
- Remarketing via Meta and Google.
8.3 Storage and Deletion
- Card information and payment data are stored and processed exclusively by Stripe. Memorabilia.auction never stores card information.
- Users may update or delete their card at any time via their user account.
- Data related to auctions is stored in accordance with applicable accounting and bookkeeping law.
9. Complaints and Disputes Between Buyer and Seller
- Any claims, complaints, or disputes relating to an item's condition, authenticity, or delivery shall be directed to the seller.
- Memorabilia.auction is not a party to the dispute and has no obligation to resolve, investigate, or mediate such matters.
- Memorabilia.auction may, at its own discretion, forward contact information between the parties if needed.
10. Account, Termination, and Suspension
- Users may close their account at any time by contacting Memorabilia.auction.
- Memorabilia.auction may suspend or terminate a user's account in the event of a breach of these terms, suspected fraud, or other activity that harms the platform or other users.
- Binding bids or agreements already entered into are not affected by account termination.
11. Force Majeure
Memorabilia.auction is not liable for delays or failure to perform the platform's services caused by circumstances beyond the company's control, including but not limited to outages at third-party providers (such as Stripe), power outages, internet disruptions, or other force majeure events.
12. Governing Law and Jurisdiction
- This agreement is governed by Norwegian law.
- Any disputes shall be resolved under Norwegian law, with Vestfold District Court (Vestfold tingrett) as the agreed venue.
- Buyers may also contact the Norwegian Consumer Authority (Forbrukertilsynet) or another relevant complaints body.
13. Changes to These Terms
Memorabilia.auction reserves the right to update these terms. Material changes will be communicated by email and/or upon next login, with reasonable notice before the changes take effect.
14. Free Assessment (AI)

Memorabilia.auction offers a free, preliminary assessment of items using artificial intelligence, based on source research and image analysis. This assessment is intended only as a starting point and is not a professional or expert appraisal of the item's authenticity or value.
- The AI assessment may contain errors and should not be relied upon for purchase or sale decisions without further verification.
- Memorabilia.auction accepts no liability for financial loss or other consequences resulting from the AI assessment being incorrect, incomplete, or misleading.
- For a final and binding assessment of items, we recommend contacting an independent specialist in the relevant field.
- By completing and registering for an assessment on Memorabilia.auction, you agree that we may send you email information and notifications about future auctions. You may unsubscribe at any time.
