Terms and Conditions for Memorabilia.no

1. About Memorabilia.no

Memorabilia.no is operated by Promotion Systems AS, organization no. 938 508 631. The platform serves as a digital marketplace and auction platform for buying and selling memorabilia and collectible items between sellers and buyers.

Memorabilia.no acts solely as an intermediary facilitating contact and agreements between sellers and buyers. Memorabilia.no is not a party to the sale transaction itself.

2. Registration and User Account

To participate in auctions as a buyer or seller, you must register with your full name, email address, phone number, and address. By registering, you accept these terms and conditions.

Only one person may use a registered account. The account holder is solely responsible for all activity linked to their account.

3. Roles and Responsibilities

3.1 Seller’s Responsibility

  • The seller is the legal party to the sale and is responsible for providing accurate information about the item.
  • The seller is solely responsible for the item's authenticity, condition, ownership rights, and legal eligibility for sale.
  • Memorabilia.no disclaims any liability for defects, inaccuracies, or issues related to the items.

3.2 Memorabilia.no’s Responsibility

  • Memorabilia.no is only the facilitator of the auction platform.
  • Memorabilia.no holds no responsibility for the fulfillment of agreements between buyers and sellers.
  • Any disputes between the parties must be resolved directly between buyer and seller.

4. Auction Rules

  • All bids are binding. The highest bid at the end of the auction period wins the auction.
  • There is no right of withdrawal for items purchased at auction, as per the Norwegian Right of Withdrawal Act, Section 22 (e).
  • Both sellers and buyers are obligated to complete the transaction in accordance with applicable laws.

5. Payment and Settlement

  • Payments are made directly between buyer and seller. Memorabilia.no does not receive or hold payments on behalf of any party.
  • Buyer and seller are responsible for handling payment, delivery, and any applicable VAT between themselves.

Memorabilia.no uses Stripe and Stripe Connect as the main payment partner:

  • All buyers and sellers must register a valid payment card to participate in auctions or place bids. Card information is stored securely by Stripe and not by Memorabilia.no.
  • For completed sales, the buyer will automatically be charged via Stripe if the seller has chosen Stripe as their payment method.
  • Payments from buyer to seller are processed directly via Stripe Connect if activated by the seller. Memorabilia.no never transfers funds on behalf of the parties.
  • Platform fees from both buyers and sellers are automatically charged by Memorabilia.no via Stripe.

Sellers who do not wish to use Stripe can offer alternative payment methods outside the platform, such as PayPal, Vipps, or other agreed solutions. Payment settlement and responsibility then lie directly between buyer and seller.

Memorabilia.no is not responsible for the execution or settlement of transactions between the parties.

6. Fees and Costs

  • Memorabilia.no charges commission from both buyers and sellers.
  • The applicable fee amount is clearly stated for each item before bidding.
  • There are no fees for creating auctions or for unsold items.

7. Privacy and GDPR

Memorabilia.no processes personal data in accordance with the Norwegian Personal Data Act and the EU General Data Protection Regulation (GDPR).

7.1 What data do we collect?

  • Name, address, email, phone number
  • Bidding history, invoice details, and payment status
  • Favorited items
  • Registered payment card (stored only by Stripe)
  • Preferred payment methods (Stripe, PayPal, Vipps, or others)

7.2 How do we use your data?

  • Transactional communication related to bids, winning notifications, and auction follow-up
  • Automatic charging of fees owed to Memorabilia.no upon sale completion
  • Payment transfer to the seller via Stripe Connect, if applicable
  • Sending newsletters (optional and can be unsubscribed at any time)
  • Remarketing via Meta (Facebook) and Google

7.3 Storage and Deletion

  • Payment card details and payment data are stored and processed exclusively by Stripe. Memorabilia.no does not store card information.
  • Users can update or delete stored payment cards at any time through their account.
  • Auction-related data is stored in compliance with Norwegian accounting laws.

8. Complaints and Disputes

  • Any claims, complaints, or disputes must be addressed directly to the seller.
  • Memorabilia.no may assist in establishing contact but is not a party to the dispute.

9. Governing Law and Jurisdiction

  • These terms are governed by Norwegian law.
  • Any disputes shall be handled under Norwegian jurisdiction, with [Nearest District Court] as the legal venue.
  • Buyers may also contact the Norwegian Consumer Council or other relevant complaint boards.

10. Changes to Terms

Memorabilia.no reserves the right to update these terms. Significant changes will be notified via email and/or upon your next login.
